What Massachusetts Law Requires Before a Child Can Leave the State
G.L. c. 208, section 30 is the removal statute that governs these cases. It applies to any child who is a native of Massachusetts or has lived in the state for at least five years and is under the custody jurisdiction of a probate court. A child covered by the statute can’t be taken out of Massachusetts without either the child’s own consent (if old enough to give it meaningfully) or the consent of both parents. When parents disagree, the moving parent must obtain a court order before the child can leave.
A parent who moves a child across state lines without consent or a court order risks a contempt finding, an order requiring the child’s return, and potentially a change in custody.
