Types of Divorce Under Massachusetts Law

Massachusetts divorce law is governed by M.G.L. Chapter 208. The large majority of cases are filed as no-fault divorces citing irretrievable breakdown of the marriage, but the specific filing method carries real strategic weight.

A 1A divorce is a joint no-fault petition: both spouses have agreed on all issues and signed a separation agreement covering property division, custody, and support before filing. A 1B divorce is filed by one spouse alone when full agreement isn’t reached. Under M.G.L. c. 208, a 1A judgment nisi becomes absolute after 120 days; a 1B judgment nisi becomes final after 90 days.

Fault-based grounds remain available under Massachusetts law. Recognized grounds include adultery, utter desertion, gross and confirmed habits of intoxication, cruel and abusive treatment, impotency, and imprisonment for five or more years. The Norfolk Probate and Family Court is located in Canton and has jurisdiction over divorce, custody, child support, alimony, property division, and abuse prevention matters for residents of 28 towns across Norfolk County.
