Massachusetts Divorce Law: What Wellesley Residents Need to Know

Divorce in Massachusetts is governed by Chapter 208 of the General Laws. The state allows both no-fault and fault-based divorce. No-fault divorce is based on the irretrievable breakdown of the marriage and doesn’t require proving marital misconduct. Fault-based grounds include desertion for one year, adultery, impotency, gross and confirmed habits of intoxication, cruel and abusive treatment, refusal to provide support, and a sentence of imprisonment for five or more years.

A joint no-fault filing uses a 1A petition, where both spouses agree on all terms and file together. A 1B petition is a no-fault filing made by one spouse when full agreement hasn’t been reached. It’s a contested no-fault track, not a fault-based one. Fault-based divorces are filed separately under Section 1 of Chapter 208. Massachusetts is not a community property state. Courts apply equitable distribution principles, dividing marital property fairly based on statutory factors rather than a required 50/50 split.

Residency requirements depend on where the grounds arose. If the grounds occurred in Massachusetts while both spouses lived here, either spouse may file immediately. If the grounds arose elsewhere, the filing spouse must have lived in Massachusetts for at least one year. After a divorce judgment is entered, a 90-day nisi period runs before the divorce becomes final. Couples filing jointly must also wait 30 days before that period begins.
